Terms applicable to Physical Activities
If your booking relates to any physical activity you accept that you are voluntarily taking part in the activity and agree to comply with the following terms and conditions:
You must act responsibly and sensibly at all times.
You must not participate if you are pregnant or under the influence of alcohol or non-prescription drugs.
You must follow any safety warnings or instructions displayed or given to you by a member of staff. Ask a member of staff if you are unclear.
You confirm that you do not have any pre-existing medical conditions that may preclude you from taking part in the activity.
ARC is not qualified to express an opinion that you are fit to safely participate. You must obtain professional or specialist advice from your doctor before participating .
In the absence of any negligence or other breach of duty by ARC, participation in the activity is entirely at your risk and you acknowledge that ARC, the Park Management Company, and their respective officers, directors, agents, contractors, employees, volunteers, members and representatives are not responsible for any injury, loss or damage of any kind sustained by any person, whilst participating in this event or activity.
Terms applicable to use of Office Facilities
If your booking relates to use of any office facilities (which includes desks and meeting rooms) you agree to comply with the following terms and conditions:
You agree:
to comply with all existing and future regulations ARC may choose to impose in relation to the use of the offices or the building and/or car parking
to use the accommodation for office purposes only
whenever any key or entry card to the offices or the building is lost or other means of access is lost to report such loss to ARC promptly and to pay on demand the cost of replacing such means of access
You agree not to:
do anything in the offices or the building which is or may become a nuisance or annoyance or cause danger, injury or damage to ARC or other occupiers or facility users
alter or damage any part of the offices or building or install any fixtures, fittings or equipment in the offices
display or affix any notice, advertisement, placard or name plate to any part of the offices or building
bring any animal into the offices or the building
smoke in any part of the offices or building
Use of the facilities is as licensee only and no relationship of landlord and tenant is created
Where you access the internet using a connection provided by or on behalf of ARC (whether via WiFi or other means) you may only use that connection for lawful purposes. You may not use the connection:
in any way that breaches any applicable local, national or international law or regulation
in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
for the purpose of harming or attempting to harm minors in any way
to bully, insult, intimidate or humiliate any person
to send, knowingly receive, upload, download, use or re-use any material which does not comply with the content standards of the relevant network provider
to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam)
to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
In the absence of any negligence or other breach of duty by ARC, the use of the office facility is entirely at your own risk.
Terms applicable to use of all ARC Facilities
The following terms and conditions apply to use of all ARC facilities:
This booking is personal to you and cannot be transferred
You agree to comply with any written rules or regulations concerning the facilities provided by ARC from time to time
Where the activity comprises more than one individual such individuals shall be jointly and severally liable to observe and perform the terms and conditions in this notice
ARC may vary or withdraw any facility or activity in its absolute discretion on notice
ARC retains control, possession and management of the facilities and you have no right to exclude ARC from such facilities
Loss or Damage to Property
In the absence of any negligence or other breach of duty, ARC is not responsible for any theft, damage, destruction or loss of your property or belongings while using its facilities or participating in events or activities.
Termination
ARC shall be entitled to terminate this booking with immediate effect if you fail or neglect to perform or observe any of the above terms or conditions relevant to the activity being undertaken.
